In doing this, we prove the following: “You are not physically or mentally able to do the requirements of your occupation, therefore, you are disabled”. What factors determine whether you can settle the case?
There are a number of factors that determine whether your claim can be settled. First, the medical information on your case is a very important part of getting a settlement. Another important factor in getting a settlement is convincing the insurance company you are serious about your case. If the insurance company believes you are serious about suing them, they will assess the legal costs to them of taking the case to trial. If I get an LTD settlement, will I keep getting monthly benefits?
In our experience, most LTD settlements are a one-time, large lump sum payment. If you received such a payment, you would not keep getting monthly benefits. Instead, you will get a lump sum payment that included all of your back benefits owing, plus an amount towards your future benefits. In exchange for your monthly benefits, you would instead receive a very large lump sum payment.
Some settlements do involve a mix of lump-sum payments and then reinstatement of monthly benefits. However, it is more common for a person to receive a larger one-time payment that includes both past and future disability benefits.
Is there anything included in my disability settlement other than just my monthly benefits?
Yes, on many occasions, we can convince the insurance company to pay you more than just the monthly benefits. The LTD settlement can also include extra money to compensate you for any poor behaviour or mistreatment of you by the insurance company. Often, the settlement also includes extra money to cover some of the legal costs of hiring a lawyer.
