What is a Disability Claim?

A disability claim is made whenever someone cannot work and they have valid benefits through their insurance company. At that point, the disabled person fills out paperwork (called an “application”) and submits this to the insurer. More often than not, the insurance company denies the claim and sends the person a letter stating the claim is being turned down.

The most common type of claim we deal with are disability insurance (LTD) claims. These come from insurance policies that promise to pay someone for their ongoing missed time from work if they are disabled due to illness or injury.

What does Bungay Law offer for denied LTD claims?

Bungay Law investigates your LTD claim to make sure it was denied for valid reasons. Insurance companies have what is called a “fiduciary duty” to you as someone who paid premiums. This is basically a legal promise that the insurance company will not act in a negative way that is harmful to you.

Unfortunately, our investigations show that insurance companies often break this promise when they deny disability claims. This promise to treat you fairly is broken in a number of different ways:

  • Insurance companies can be too selective about what medical records they rely on. For example, when denying your claim, the insurance company may ignore a medical record that says you are disabled and just focus on something that says you can work.
  • Insurance companies can make arbitrary decisions without having all of the evidence they need. For example, the insurance company may decide you are not disabled without bothering to ensure they have all the facts about your job or your disability
  • Insurance companies, at times, can just be plain sloppy when denying your claim. They can be sloppy by not listening to you or by deciding you can work when the evidence clearly notes you cannot, in fact, work.

What can be done if your claim is not handled fairly?

At Bungay Law, if the insurance company has not handled your claim fairly, we sue them in Court. In doing this, we write a legal brief or document telling a judge all the ways you have been mistreated. By doing this, we create a public record of their poor conduct. Insurance companies do not like to look bad, because they are running a business based on trust. By threatening to expose their poor treatment of you in Court, we can convince them to settle your case and pay you a lump sum of money.

Getting the adjuster to explain their decision

When an LTD claim is denied, the adjuster sends a standard letter and puts their signature at the end of it. This “standard” letter is often just a copy of a similar letter sent to hundreds of other people. The only difference may be your name on it instead of someone else with a denied claim.

At Bungay Law, we pride ourselves on forcing insurance agents and adjusters to explain their decisions. They cannot hide behind a desk once we are on the case. If your claim is not approved, we can legally require the adjuster or agent to attend a court hearing where they will have to explain in detail why they denied your case. Often, when we apply that kind of pressure, the insurance company caves and pays out benefits for the disabled person like you.

How much does it cost to have your claim approved by the insurance company?

Bungay Law does not charge any money to have your case reviewed in the initial meeting with us. If you hire us for your LTD claim, we will not bill you for anything unless we win your case. This fee only comes later if we make sure your claim is successful. If we can win your LTD claim, this usually means you get one large sum of money as a settlement. Our fee is a modest percentage of any settlement that we win for you.
