Some law firms do not provide guidance or advice on appeals.  Some law firms charge by the hour to review an appeal.  This is not how it works at Bungay Law.  We will review your disability appeal free of charge.  One of our disability specialists will analyze the letter from your insurance company denying your claim, and give you feedback on whether we think you can win the case.   All of this we do for you without charging you a cent.

It is very important to have the right law firm to examine whether or not you have a good chance of appealing the disability decision.  Like any professional opinion, experience counts.  In order for a disability lawyer to give you good advice, that lawyer must know what it is like to fight insurance companies.  At Bungay Law, we have the experience needed to properly review your appeal and, if necessary, to make the appeal on your behalf.

The Disability Appeals Process

The disability appeal process is the first step we take toward getting your LTD – Disability claim paid out.  This process usually starts with an insurance company sending you a letter that denies your case.  In that letter, the insurance company will tell you that you have a right to “appeal” the decision.  Often, the letter sets out a deadline for the appeal.

One of our disability appeals lawyers will review that letter in great detail.  We use the letter, in part, to determine the strengths and weaknesses of your case.  For example, we often learn why the insurance company is denying your claim.  More importantly, by asking you questions, we can often determine whether you can have a successful disability appeal.

If we feel your case is very strong, we will write a letter to the insurance company for you.  In that letter, we would explain, in clear legal terms, why the insurance company was wrong to deny your case.  After this, if the insurance company denied your disability appeal, we would give notice that we will be seeing them in Court.  We would then have our lawyers start the process of taking the denial of your appeal to Court.

Helping get your Medical Evidence

At Bungay law, our disability lawyers can help you get the medical evidence you need to have a successful appeal.  We have 15 years of experience talking to family doctors.  This means that, if your doctor does not fully understand your disability, we can meet with your physician to help them better understand what is needed to win your appeal.

Our disability specialists also have relationships with independent medical experts.  These are physicians who specialize in assessing people like you to verify your disability.  By hiring such an expert, our team gets you a proper and thorough medical assessment. Often, the results of these assessments can lead to victory in your LTD – disability case.

Common Questions: Disability Appeals

What kind of evidence do I need to submit in a disability appeal?

Usually, the insurance company denies your appeal because they feel that the medical evidence they have does not show you are disabled.  Because of that, if you feel the insurance company missed something, it will be important to make sure all doctor’s reports and records relating to your disability are sent to them.  More often than not, most people have difficulties getting these records on their own. Our law firm specializes in getting such records. Our team can get your complete medical file quickly on your behalf to help you win your appeal

The insurance company has set a deadline for my appeal? Is this important?

Whether or not the deadline is legally important will depend on the details of your policy.  However, in many cases, the deadline given by the insurance company is meaningless.  Often, if you miss this deadline, you can still take legal action to ensure your disability benefits are paid.  Advice from an experienced disability appeals lawyer is important to determine how important the deadline is.

Is the “appeal” part of the legal system, or Court system?

In most cases, the “appeal” you are told about has nothing to do with the legal system.  The appeal is usually an internal process within the insurance company itself.  In other words, the same employee who said “no” the first time may be the person deciding whether to say “no” again when you make the appeal.  This is why most appeals, without legal help, are not usually successful.

Why consult with Bungay Law about your disability appeal?

Bungay Law wants to give you advice on your appeal without charging you any money.  It is our pleasure to review your case and give you some peace of mind, even if our advice is “we can’t help you”.  However, in most cases, we really can help.  We have a great record of fighting with insurance companies, and we are always squarely in the corner of our clients.
